Terms of use — Z-ARK

1. Purpose

These terms govern the use of the Z-ARK software, its plugins, the Z-ARK account created on z-ark.fr, and the “Z-ARK” and “Z-Death” Discord bots, published by AUTEF Alexis, sole trader (see the legal notice). Creating an account, installing the software or adding a bot constitutes acceptance of these terms.

Purchases (licence, paid plugins) are also governed by the terms of sale.

2. The Z-ARK software

Z-ARK manages ARK: Survival Ascended game servers installed on the user’s machine. Its basic version is free, with no time limit and no limit on servers. Some advanced features and some plugins require a paid licence.

The user receives a personal, non-exclusive and non-transferable right of use. The code, the brand and the content remain the publisher’s property. It is forbidden to resell or redistribute the software, to bypass or disable the licence check, or to decompile it outside the cases permitted by law.

Each Z-ARK archive is personal: it carries a mark linked to the account that downloaded it. Do not share it; to install Z-ARK elsewhere, download it from your account. An archive distributed without permission can be identified, and the original account suspended (section 5).

3. The Z-ARK account

  • The account is created on z-ark.fr with a valid e-mail address and a password. It is used to link one’s machines, obtain a licence, buy and get support.
  • An account is personal. The user keeps their password confidential and is responsible for what is done from their account.
  • The user must be of the age required by the law of their country to consent alone to the processing of their data (15 in France), or have a parent’s consent.
  • The user can ask for their account to be deleted at contact@z-ark.fr. Invoices are kept for 10 years, as required by law.

4. The user’s responsibility

The user runs their game servers under their own responsibility: compliance with the terms of ARK: Survival Ascended, Discord and Steam, moderation of their community, backups, compliance of their machine. They inform their players of what Z-ARK and its plugins record about them (names, messages, deaths, inventories).

5. What is forbidden

  • using Z-ARK or its bots to spread unlawful or hateful content, harassment or spam;
  • attempting to access an account, a machine or a Discord server that is not one’s own;
  • overloading, misusing or attacking the publisher’s services;
  • distributing a Z-ARK archive or a download link outside one’s account;
  • sharing or reselling a licence.

In the event of a breach, the publisher may suspend the account, a licence or a bot, after informing the user, or without notice if the situation requires it.

6. The Discord bots

Only an administrator of a Discord server holding the “Manage Server” permission can add a bot to it, on behalf of the operator of the game server. They choose the channels where the bot acts and inform their community. Relayed messages remain the responsibility of their authors; the publisher does not read them and does not keep them beyond transit (see the privacy policy). A bot can be removed at any time from the Discord server settings.

7. Availability

The software runs on the user’s machine. The publisher’s online services (website, account, licence check, support, bots) are provided on a best-effort basis, with no guarantee of permanent availability. If they are interrupted, the game servers keep running; a licence already checked remains valid for up to seven days without contact with the publisher.

8. Liability

The publisher has an obligation of means. It is not liable for indirect damage, loss of game data, or third-party services (ARK: Survival Ascended, Discord, Steam, Microsoft), which are independent of Z-ARK. Nothing in these terms limits the rights that the law grants to consumers.

9. Changes

These terms may change; the version in force is the one published on this page, with its date. In the event of a significant change, account holders are notified by e-mail.

10. Governing law

These terms are governed by French law; consumers residing in another European Union country keep the protection of the mandatory rules of their country. Contact: contact@z-ark.fr.
