General terms of sale — Z-ARK
Translation provided for convenience: the French version is the one that is legally binding.
Version 3 — in force from October 4, 2026. It replaces version 2 for orders placed from that date; earlier orders remain governed by the version accepted when ordering.
1. Seller
These terms govern sales concluded on z-ark.fr or from the Z-ARK software between:
- AUTEF Alexis, sole trader (entrepreneur individuel, Zarkk Informatique), 16 allée Pierre Loti, 46130 Biars-sur-Cère, France — SIRET 105 110 548 00010 — contact@z-ark.fr — +33 6 30 42 49 98 (hereinafter “the publisher”);
- and the person who buys a licence or a plugin (hereinafter “the customer”).
2. Sale reserved for private individuals
Sales are reserved for consumers: natural persons buying for their personal use, outside any professional activity. By ticking the acceptance box, the customer declares that they are buying in this capacity.
The publisher issues neither invoices in the name of a business nor invoices bearing a VAT number. If it appears that an order was placed for the needs of a professional activity, the publisher may cancel it and refund it in full.
Any order implies acceptance of the terms in force on the day of the order, which the customer accepts by ticking the box provided before payment.
3. What is sold
The Z-ARK software, which manages ARK: Survival Ascended game servers, is free and remains so: its free version, with no time limit, gives access to the core (starts, stops, restarts, backups, restart after a crash, updates, Discord link, viewing players, unbanning and whitelist, starting, stopping and automatic recovery of databases, up to 3 accounts).
The publisher sells fixed-term usage rights, which unlock, for all installations attached to the customer’s account:
- Z-ARK licence: trying ARK updates on a test server, sanctions (warn, kick, ban) from a player’s page, copying backups to another disk, publishing admin and ban lists, phpMyAdmin and the takeover of existing databases, and an unlimited number of accounts;
- Z-Death plugin: the record of each death and the return of what was lost, without duplicates;
- Z-Clean plugin: the inventory of the structures that make servers lag, and their cleanup on command.
The content purchased is the one described above on the date of the order; it cannot be reduced during the paid period.
The licence is checked online. A checked licence remains valid for up to seven days without contact with the publisher’s service; it is checked again as soon as the connection is back.
The customer does not buy the software itself: they obtain a personal, non-exclusive and non-transferable right of use, for the period purchased. The code and the brand remain the property of the publisher.
4. Prices
Prices are shown in euros, all taxes included, before payment. VAT not applicable, article 293 B of the French General Tax Code.
As of the date of these terms: licence or plugin, €3 for 3 months or €10 for 1 year. Several products can be paid for in a single payment. The applicable price is the one displayed at the time of the order.
5. Order and payment
The customer creates their account on z-ark.fr, then, from the Z-ARK software, chooses their product and duration, accepts these terms and pays online by bank card or PayPal, on the payment page of the provider Stripe. Payment is due on ordering. The publisher neither receives nor stores any bank card data.
A confirmation e-mail summarises the order, the start and end dates of each licence and, where applicable, the waiver of the right of withdrawal (article 7). The invoice is attached to this e-mail and remains available in the Z-ARK software.
6. Delivery and duration
The licence is activated automatically as soon as payment is confirmed and attached to the customer’s account; the software takes it into account at its next check, usually within minutes.
It runs for the period purchased, three months or one year:
- from payment, if the customer has no licence in progress for this product;
- from the end of the current period, if the customer extends a licence that is still active: they thus lose no day already paid for.
No commitment: nothing renews automatically. At the end of the period, the customer may buy a new period; otherwise, the software returns to its free version. The game server keeps running: only the paid features close, and no data is deleted.
7. Right of withdrawal
Consumers have 14 days from the purchase to withdraw.
- Licence that starts immediately: as the licence is digital content supplied immediately, the customer expressly requests, before payment, immediate performance and acknowledges losing their right of withdrawal upon activation (article L221-28, 13° of the French Consumer Code). This request is collected through a checkbox and confirmed in the order e-mail.
- Extension that starts later: as long as the new period has not started, the customer may withdraw within 14 days of the purchase, without giving a reason, by writing to contact@z-ark.fr; they are then refunded in full, by the same means of payment, within 14 days.
8. Legal warranty of conformity
The customer benefits from the legal warranty of conformity for digital content and services (articles L224-25-1 et seq. of the French Consumer Code), for the whole duration of the licence purchased. In the event of a lack of conformity, they write to contact@z-ark.fr. The publisher brings the product into conformity within a reasonable time and free of charge. If bringing it into conformity is impossible, does not happen within that time, or if the defect persists, the customer may obtain a price reduction or the termination of the contract with a refund of the sums paid for the period not used or affected by the defect.
The software is designed for ARK: Survival Ascended servers whose game, updates and third-party services (Discord, Steam, Microsoft) the publisher does not control. A temporary incompatibility caused by a third-party update is fixed as soon as possible.
9. Liability
The publisher is bound by an obligation of means. It is liable for damage caused by a defect of Z-ARK attributable to it, under the conditions provided by law.
It is not liable for damage with another cause: the game ARK: Survival Ascended and its updates, third-party services, the customer’s machine or connection, an action of the customer, or the absence of backups. Z-ARK can back up game worlds, including in its free version: keeping regular backups is recommended.
Nothing in these terms limits the rights the law grants to consumers.
10. Prohibited use and suspension
It is forbidden to circumvent or disable the licence check, to resell or share a licence, or to decompile the software outside the cases permitted by law.
In the event of a serious breach, the publisher may suspend the licence concerned, after informing the customer and giving them the opportunity to explain themselves, or without notice if the situation requires it (fraud, attack on the publisher’s services). If the suspension is unjustified, the lost period is restored or refunded. The same rules appear in the terms of use.
11. Personal data
The data needed for the order (e-mail, licences, invoices) is processed as described in the privacy policy. Invoices are kept for 10 years, as required by law.
12. Complaints and mediation
For any complaint: contact@z-ark.fr or +33 6 30 42 49 98. The publisher replies within 15 days.
Failing an agreement, the consumer may refer the matter free of charge to the consumer mediator the publisher belongs to, within one year of their written complaint:
CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice
49 rue de Ponthieu, 75008 Paris — www.cm2c.net
13. Applicable law
These terms are governed by French law. A consumer residing in another European Union country keeps the protection of the mandatory rules of their country. Failing an amicable solution, the competent courts are those designated by law.
14. Versions
These terms may change. The version applicable to an order is the one accepted when placing that order; each version remains available at its address (z-ark.fr/terms-of-sale/v1/, /v2/, /v3/).
